As part of our registration process, we must verify candidate's right to work. We do sometimes receive questions regarding why we must undertake these checks and if they are necessary. In short, 100% necessary.
In the UK, agencies must check your right to work before submitting your CV to a client to comply with immigration and employment laws. The Immigration, Asylum and Nationality Act 2006 requires employers, including recruitment agencies, to verify that all candidates have the legal right to work in the UK.
Failing to do so can lead to significant penalties for the agency and the client, including fines and potential criminal charges. Checking this upfront ensures that candidates are eligible for employment, prevents illegal working and protects both the agency and the client from legal risks. This process helps streamline recruitment and avoids delays during the hiring process.
Therefore, if an agency does not check your right to work, we would have concerns. Any reputable, law abiding agency will perform these checks and will do so in a secure manner.
